Mock B under exam conditions on 2 December 2021 (and in 3 Feb 2022)

A mock B exam under exam conditions allowing you to test the updated WISEflow version with video/audio invigilation is available on 8 December 2021. See here.

The main purpose of the December Mocks is to test your equipment and settings, including camera and audio.

You can practice the papers at a later moment, as they will again be made available as Mock papers for a longer period, but without invigilation.

It has also been announced by email from the EQE secretariat to all candidates that, i a further mock under exam conditions will be conducted on 3 February 2022The purpose of this mock is to check your equipment and settings. This mock will not contain a new paper, but a known paper used in the currently open mocks.

Please feel invited to post your experiences with the Mock and the platform, comments and tips as comments to this blog. It is appreciated if you use your name or a nickname in your post, for easy reference (you can use the Anonymous option and close the message with your name, or use the google account or name option).

  1. Wiseflow/Flowclock has been improved for the main exam papers:

The pdf viewer now allows annotation:
    - highlight, underline,
    - free form shapes/drawing, shapes in 4 colors,
    - comments on the page, comment balloons

    The editor now allows:
    - strikethrough
    - copying from the pdf viewer into the editor using Ctrl-C - Ctrl-V has been improved (it does no longer break every line after several characters, which it dod before)

Use the opportunity to test the updated, improved version with the Mocks, and familiarize yourself with the tools and options!

  2. The epi Mock B from today is derived from B e/m 2006.

Compared to the original paper, the Communication was updated to current style and standards, a proposal for claims amendments from the client was added to align with the current B format, and the client's letter was extended to clarify the needs and wishes of the client and the reasons for his proposed amendments.

  4. I checked the loading time for Paper B:

It took 3 minutes 20 seconds to load the paper at the start. After ~2 minutes, the Tab window changed from white to grey, but it took another ~1 minute before the paper became available. (Note: I am not sure whether clicking in the grey window helps to see the paper quicker)
Loading the paper again in another Tab goes within seconds.

The B paper is quite some more pages than the A paper (which took around 2 minutes), which is maybe why it took longer to load it - how long will C take to load?

Tip: if the paper does not load immediately in the separate tab, wait for a few minutes.

  5. Unfortunately, when copying the proposed amended claims from the pdf into the editor using Ctrl-C Ctrl-V, the markup (underlining, strikethrough) gets lost.
Also, the claim numbers shows up on separate lines rather than at the beginning of the first line of each claim. Since markup is not shown, amended claim nubmbers show together with original claim numbers.

You will thus need to carefully edit the claims after you copied them (add strikethrough and underline, or make a clean copy from them).

Yes it is not perfect, but still beter than the previous version of wiseflow browser. And careful reading of what we copy-paste is needed. I will suggest to copy the original claim then the amended one below to always have a good overview and not miss (the little words that the applicant per accident forgot).
What I found annoying was the right windows that pop up after adding a comment. No way found to close it and the lines to all the annotations where very disturbing. My only way out was to open again the document in a new tab (own annotation are not lost and the layout of the window is clear).
Then I hope that during the exam the outline of the pdf will be correct to enhance navigation between the documents (here only drawing of application and prior art documents). Anyway thank you for sharing all these tips.

  6. I also realized that, at the left panel of the separate tab where the assignment (mine was the English version) is shown, there are outlines. But through these outlines, I could only access the description of the application, document D1, and the drawings of documents D3 and D4.

It would be helpful if one could access all the relevant documents of the entire assignment from the outlines of the left panel, instead of having to scroll up and down through all the pages of the assignment to find a particular document at a particular time.

    1. I checked the German and French versions:
The German outline only showed the Zeichnungen von Document D3 and Zeichnungen von Document D4, but not the description, D1 nor D2.
The French outline only showed the Dessigns de la demande, but nothing else.
It seems that no attention was paid to the outline in the left panel, as it is different for the three languages and not complete.

I think we can assume that it will be complete for the real exam paper. You may want to check it in future Mocks.

Note that you can also open the paper multiple times. in multiple tabs, so that you have your editor in the first tab, the application in the second tab, the figures in the third tab, D1 in the fourth tab, ...
If you try to open too many tabs, the system will warm you (unlike in the 2021 version).

    2. Is there a keyboard shortcut to select the tabs?

  7. I was very nervous when the WiseFlow browser opened- due to my trauma of e-EQE 2021. Although it has been improved, it is still a terrible editor!
I could not print out anything before the flow started. During the flow, I could not open extra tabs at the beginning as they would not load. After several tries/minutes they started to work. The problem of the tab names still exists. They are all called "Wiseflow" and you cannot manually change them.

  8. I worked in French language. I opened the flow one hour before the start, as requested. At 9,30 h, the "Supports supplementaires" were not available and I could not print them (namely the "Dessins de la demande" and D1-D4]. I worked without the printings.

They came very late... less than 20min before start (but still enough time to print them and start reading the prior art). I always make a refresh of the page. On the day of the exam this will be I think/hope good monitored.

Did you also noticed that the EPI model solution does not comment on the "forgotten" copolymer in claim 4 of the client proposal, or I am missing something ?

  10. The German translation is a mess! For example original claim 4 recites "Gewichtsprozent". So, there was no clarity problem with original claim 4.

  11. I have one question on the proposed claim 4: the combination of sodium silicate and the ethylene vinyl acetate. isn't it such specific combination new/novel as compared to the original disclosure in the application as filed?
    many thanks,
    Peter

  12. I was only able to download and print the "Additional material" after the exam. It was not visible prior to entering the LockDown browser. Anyone else had that problem?

    1. Dear Tim...I had also this problem

    2. I had this problem too. It has made me very anxious. The same problems occurred at the real eEQE. I complained within 24 hours at the EQE committee. They told me my problems were taken into account in my marking. I FAILED.

    3. In general (i.e., unless there was an individual or general hickup), you may need to refresh your browser to see the preprintable material - which should be available at the latest 10 minutes before the start of the flow (and before entering the flow!). Did you do so?

If you encounter such type of problems: immediately contact the invigilator to have your issue on file, and consider to file a formal complaint to the EQE secretariat immediately after the exam (see Rule 19(3) IPREE).

IV. Preparation and start of the examination

"5. Where possible, candidates wishing to print any parts of an examination paper must do so as soon as the relevant parts are available. To see the printable parts, candidates must refresh the page before launching the FLOWlock browser."

Hi everybody. Just a question concerning the earlier Mock B (solar collector). Is there any published model solution? Thanks!

  14. I would also like to know if there is a model answer to B 2021. The guidance and candidate's answer in particular from the EQE committee was not so helpful to me.

    1. No, unfortunately a model solution to the B 2021 paper as you would expect from previous B papers does not exist. Rather, a wide range of possible answers has been accepted, each with its own shortcomings in terms of scope of the protection conferred, respecting the client wishes, strong inventive step defense, etc. The B 2021 paper has been drafted in such a way that the ideal or most obvious solution is not available to candidates, but candidates were expected to make more individual choices. This is at least the impression I got when I read the Tutor's report for the EQE 2021 in the last edition of the epi information. So yes, the candidate's anwer and model solution of the compendium are not as helpful as they used to be if it comes to comparing your solution to other solutions.

  15. Is anyone else here concerned about how to deal with the new guideline H-VI, 2.2.1 on bringing the description into line with amended claims in paper B?

    https://www.epo.org/law-practice/legal-texts/html/guidelines/e/h_v_2_7.htm

Strictly speaking, one would have to react here somehow accordingly...

    2. You do not need the March 2022 Guidelines in EQE 2022, but the one in force in 31.10.2021 so the previous one.

And you do not need to amend the description in paper B: see Rule 24 IPREE:
      (3) Candidates are expected to respond to all points raised in the official communication. The response shall be in the form of a letter to the EPO accompanied by the claims supplied by the client, amended as appropriate to meet the requirements of the EPC. The description shall not, however, be amended. In their reply, candidates shall identify clearly all amendments made in the claims and their basis in the application as filed, and provide additional explanations where necessary. Candidates shall also set out their arguments in support of the patentability of the independent claim(s).

    3. It is also in the previous GL. But, anyhow, said Rule 24 addresses exactly my qustion. Thank you, Roel
